Abstract: the purpose of scientific work is the research of legal aspects of licensing of educational activity from positions of science of administrative law. The circle of subjects which obtain the license is allocated, the concept and the main signs of the licensed educational activity is defined and also judicial practice on the main problems of licensing in education is analysed. Special attention in research is paid to an order of the procedure of licensing in the Russian Federation and also to the main difficulties accompanying it. Ways on improvement of separate aspects of license production are planned. The research is conducted on the basis of Institute of the state and the right of the Russian Academy of Sciences. The methodology of research was based on application of historical, logical, dialectic receptions and ways of scientific knowledge and also a method of the social and legal interpretation of the studied terms allowing to formulate definitions of concepts in relation to education
