Abstract: the article analyzes the problems of the definition of “state and municipal needs”. The grounds and order of the expropriation for state or municipal needs are revealed. The author proposes to replace the notion “state and municipal needs” on the concept of “public needs” as he considers appropriate that this concept emphasized the social necessity of withdrawal, not the needs of the state as is done currently.
