LEGAL REGULATION OF POSTING COVER VERSIONS OF MUSICAL WORKS ON THE INTERNET

Abstract: turning to the history of the emergence and development of music, its relevance as a piece of art became obvious.

Discussions around the mode of legal regulation of a musical composition which such has, by virtue of its belonging to objects of copyright (article 1259 of the Civil Code of the Russian Federation), is not a phenomenon. However, the rapid development of the digital ecosystem provokes the imposition of conflicts on disputes that already exist. So, on the one hand, in recent decades, the society opened up a virtually unobstructed path to cultural values. However, there is another side of the coin: the limited author’s capacity to track users of their work entails the lack of the stable maximum benefit from the creative work.

At present, the legal reality within the framework of the topic of discussion is the following: the problem of hosting cover versions of musical works in the Internet resources is becoming more acute, which makes using of other author’s works even more out of control.

Considering designated the aim of the work is to establish the legal consequences of placing cover versions of musical compositions in the network.

The main conclusions are there: the publication of cover versions in the network without the consent of the copyright holder is possible in some cases. Among those we identified the next ones: the period of exclusive rights expired; the work has the status of a national anthem, subject’s or municipality’s anthem; the work is the subject of folk art. In the other cases, we must receive the permission of the right holder to use musical composition as a base of our cover version. Among the reasons of copyright infringement are the infinite possibilities of filters used in the framework of the Internet platform, and the low awareness of citizens about the legal consequences of this category of offenses.
